The court held an oral argument regarding the enforceability of arbitration agreements within employment contracts. The discussion focused on whether such agreements, particularly when presented as click-through terms in online job applications, constitute unconscionable contracts of adhesion that deprive employees of their constitutional right to a jury trial. The dialogue explored legal standards for determining the reasonableness of these agreements, the necessity of clear notice and informed consent, and how contract law principles apply to mandatory arbitration clauses in an employment context.
